TERMS OF USE

The terms you agree to when you use Comuta

These terms govern your use of the Comuta app and website. By creating an account you agree to them. Comuta is a marketplace that connects riders and drivers sharing the cost of a journey — it is not a taxi service and does not itself provide transport.

1. About these terms

These terms are an agreement between you and Comuta Technologies Ltd.. They apply to the Comuta app, website and related services. If you do not agree to them, do not use Comuta.

2. What Comuta is

Comuta is a technology platform that helps verified riders and drivers who are travelling the same route share a journey and its cost. Drivers are private individuals sharing seats on trips they are already making, not professional taxi operators. Comuta is not a party to the journey, does not own vehicles and does not employ drivers. Contributions paid by riders are toward the shared cost of the trip.

3. Eligibility and your account

  • You must be at least 18 years old and able to enter a binding contract.
  • You must give accurate information and keep it up to date, and complete any verification we require.
  • One person, one account. Keep your login details secure; you are responsible for activity on your account.
  • We may refuse, suspend or close an account that breaks these terms or presents a safety or fraud risk.

4. Driver responsibilities

  • Hold a valid Nigerian driver’s licence and drive a roadworthy, insured vehicle.
  • Complete identity and document verification before publishing a route, and keep documents current.
  • Post your routes, times and available seats honestly, and drive the trips you post. Comuta sets the fare contribution for each pair of stops; you may not change it or ask riders for more.
  • Drive safely and lawfully, and treat riders with respect.

5. Rider responsibilities

  • Pay the fare contribution and service fee for the seats you book.
  • Be at your pickup stop on time and share your boarding code only with your driver.
  • Treat drivers and other riders with respect, and follow reasonable trip rules.

6. Bookings and payments

When you book a seat you create a booking that is only confirmed once payment is received. Payments are processed by Paystack; Comuta never handles your full card details. The price shown is the price you pay: the fare contribution Comuta sets for your two stops, which is paid to the driver in full, plus a Comuta service fee. A confirmed booking gives you a boarding code.

7. Cancellations and refunds

You can cancel a booking from Ride details in the app. Cancel 8 or more hours before departure for a full refund of your fare and service fee; cancel later and your seat is released without a refund. If a driver cancels, or seats sell out while your payment is going through, you are refunded in full automatically. Full details are in the Refund & Cancellation Policy.

8. Acceptable use

You agree not to use Comuta to break the law, harass or endanger anyone, misrepresent your identity, run a commercial taxi operation, scrape or disrupt the service, or arrange payment outside the platform to avoid fees or safety records.

9. Safety

Comuta provides trip sharing, live tracking, incident reporting and an SOS feature. These are safety tools, not a guarantee of safety. In an emergency, contact the emergency services first. Report incidents through the app so our safety team can follow up.

10. Liability

As a marketplace, Comuta is not responsible for the acts or omissions of riders or drivers, or for the journeys themselves. To the fullest extent permitted by Nigerian law, our liability to you is limited. Nothing in these terms limits liability that cannot lawfully be limited. (This section, in particular, requires review by Nigerian counsel before launch.)

11. Suspension and termination

You can stop using Comuta and delete your account at any time. We may suspend or end your access if you break these terms or to protect the safety of the community, and will tell you where we reasonably can.

12. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and disputes are subject to the jurisdiction of the Nigerian courts. We will always try to resolve a problem with you directly first.

13. Changes to these terms

We may change these terms as the service evolves. We will post the updated version here and, for significant changes, notify you in the app. Continuing to use Comuta after a change means you accept it. Questions? Email support@comuta.com.ng.
